1. Introduction

MA11 respects your privacy and is committed to processing your personal data responsibly, securely and confidentially.

This Privacy Policy explains how MA11 collects, uses, stores and protects personal data relating to models who cooperate with MA11 in connection with model representation, casting, booking and the facilitation of modelling assignments.

This Privacy Policy has been prepared in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council ("General Data Protection Regulation" or "GDPR") and applicable Danish data protection legislation.

3. Who does this Privacy Policy apply to?

This Privacy Policy applies to models who:

  • are registered with MA11 for the purpose of model representation or placement,

  • participate in castings facilitated by MA11,

  • perform modelling assignments arranged through MA11,

  • cooperate with MA11 through national or international partnerships.

MA11 operates as a model management agency and is not the employer of the models represented by MA11 unless otherwise specifically agreed.

4. What personal data does MA11 process?

Depending on the nature of the cooperation and the specific modelling assignment, MA11 may process the following categories of personal data.

4.1 General personal data

This may include:

  • name,

  • contact details,

  • address,

  • date of birth or age,

  • nationality,

  • height, measurements and other relevant model specifications,

  • information regarding experience and previous modelling work,

  • portfolio images, videos and digitals,

  • availability information,

  • information required for booking and administration,

  • payment-related information.

4.2 Information relating to modelling activities

MA11 may process information regarding:

  • previous and current modelling assignments,

  • client bookings,

  • casting history,

  • travel arrangements related to assignments,

  • professional profiles and presentation materials.

4.3 Special categories of personal data

MA11 does not generally collect or process sensitive personal data.

However, where necessary for a specific modelling assignment, MA11 may process limited information such as:

  • health-related information directly relevant to a production,

  • allergies or special requirements,

  • other information necessary to safely and properly perform a specific assignment.

Such information will only be processed where a valid legal basis exists under the GDPR.

MA11 does not collect genetic data and does not use biometric identification systems such as facial recognition technology.

5. Source of personal data

MA11 primarily receives personal data directly from the model.

Personal data may also be received from:

  • parents or legal guardians where the model is under the age of 18,

  • cooperating model agencies,

  • clients or production companies in relation to specific assignments,

  • publicly available professional profiles where relevant.

6. Purpose of processing

MA11 processes personal data for the following purposes:

6.1 Model representation and placement

MA11 processes personal data in order to:

  • present models to potential clients,

  • match models with relevant assignments,

  • manage casting processes,

  • facilitate modelling opportunities.

This may include displaying model images, portfolio material and relevant professional information on MA11's website, social media platforms and presentation materials.

Such activities form an essential part of MA11's model management services.

6.2 Booking and administration

MA11 processes personal data in order to:

  • coordinate bookings,

  • communicate with clients and partners,

  • manage practical matters relating to assignments,

  • handle payments and documentation.

6.3 International cooperation

MA11 may share relevant information with:

  • foreign model agencies,

  • casting agencies,

  • production companies,

  • clients,

where necessary to identify and facilitate modelling opportunities.

6.4 Legal and administrative obligations

MA11 may process personal data in order to:

  • comply with legal requirements.

7. Legal basis for processing

MA11 processes personal data based on the following legal grounds:

GDPR Article 6(1)(b) – Performance of cooperation

Processing may be necessary in order to manage the cooperation between the model and MA11, including bookings and facilitation of assignments.

GDPR Article 6(1)(f) – Legitimate interests

MA11 processes personal data based on legitimate interests when necessary to:

  • operate a professional model management business,

  • present models to potential clients,

  • maintain relationships with models and business partners,

  • develop and protect MA11's business activities.

MA11 has assessed that these interests do not override the rights and freedoms of the model.

GDPR Article 6(1)(c) – Legal obligation

Processing may be required in order to comply with legal obligations, including accounting and documentation requirements.

GDPR Article 6(1)(a) – Consent

Where required by applicable law, MA11 will obtain specific consent for the relevant processing activity.

8. Use of images and model materials

Images, videos and portfolio materials are used as an integral part of MA11's representation of the model.

The purpose is to:

  • present the model to relevant clients,

  • create professional opportunities,

  • manage the model's professional profile.

Materials may be displayed on:

  • MA11's website,

  • MA11's social media platforms,

  • digital presentations,

  • client-facing platforms.

When cooperation between MA11 and the model ends, MA11 will generally remove the model from active presentation channels within a reasonable period.

Materials that have already been lawfully published, including previous campaigns or archived social media content, may in certain circumstances remain available where removal is not reasonably possible or where other legitimate interests apply.

MA11 uses its website and social media platforms as part of its model management and representation activities.

MA11 does not use analytics tools such as Google Analytics or similar tracking technologies on its website.

When visiting the website, technically necessary cookies or functions required for website operation may be used by the website provider.

9. Sharing of personal data

MA11 only shares personal data where necessary.

Recipients may include:

  • clients,

  • advertising agencies,

  • photographers,

  • production companies,

  • casting agencies,

  • cooperating model agencies,

  • international partners,

  • IT providers and data processors.

MA11 does not disclose personal data to unauthorised third parties.

10. Data processors

MA11 uses external service providers that process personal data on behalf of MA11.

These may include:

  • booking platforms,

  • IT and hosting providers,

  • digital administration systems.

MA11 enters into appropriate data processing agreements where required under the GDPR.

11. Transfers outside the EU/EEA

MA11 uses digital administration and booking systems, including Media Slide, as a data processor on behalf of MA11. Processing takes place within the EU/EEA and in accordance with applicable data protection legislation. MA11 has entered into appropriate data processing agreements with relevant providers where required.

12. Retention of personal data

MA11 only retains personal data for as long as necessary for the relevant purpose.

As a general rule, model information is retained for up to five (5) years after the cooperation with MA11 has ended, unless:

  • a longer retention period is required by law,

  • the information remains relevant for documentation purposes,

  • another lawful basis applies.

Financial and accounting information is retained according to applicable accounting legislation.

13. Security

MA11 implements appropriate technical and organisational security measures to protect personal data against:

  • unauthorised access,

  • loss,

  • alteration,

  • misuse,

  • accidental disclosure.

Access to personal data is limited to individuals who have a legitimate business need.

14. Your rights

Under the GDPR, you have several rights regarding your personal data.

You have the right to:

  • request access to your personal data,

  • request correction of inaccurate information,

  • request deletion where applicable,

  • request restriction of processing,

  • object to processing based on legitimate interests,
